Terms and conditions for FIT4MOM Membership

This plan in non-refundable and non-transferable. This plan may be put on hold for a maximum of 4 months per year, with 1 month being the minimum hold allowed. In order to put your account on hold or to cancel your account, you must fill out our Membership Change Request Form with at least one month notice. This form can be accessed under the "Member Resources" tab on our website.

You may change your membership to a different plan or pass by filling our our membership form. Please note that downgrading to a lower-priced option mid-month will not result in credit to your account, so we recommend that any downgrades are requested at the end of a month so you get the most of your plan.

This contract is made between the client and FIT4MOM Montgomery County and is a month-to-month agreement. Except as provided in the initial 10 day cancellation policy below, this agreement may be terminated by either party with proper advance notice. This membership allows you to attend unlimited drop-in (non session) classes within Montgomery County in Maryland.

AUTHORIZATION FOR PAYMENT I authorize MOMentum Fitness LLC to initiate a charge to the account entered into Pike13 for my dues. This authorization is to remain effective until I have cancelled my membership through the FIT4MOM Montgomery County owner. Dues of $99 will be drawn monthly from the account on file on the first day of the month. If charges are returned they may be subject to a late fee. Members are responsible for updating their credit card information online. Members may not attend class who have unpaid balances. If a membership remains unpaid, it may be cancelled.

CANCELLATION POLICY To cancel this membership, the member must contact the FIT4MOM Montgomery County administrator at least one month prior to their next payment due date to request a cancellation. No refunds will be given for dues once it has been paid. This membership is not transferable to another person or anywhere outside the Montgomery County, MD franchise. Once a membership is cancelled, if the member wants to re-enroll they will be charged a reduced registration fee.

HOLD POLICY Memberships may be held a maximum of 4 months per hold period. Hold starts will coincide with the next date dues is scheduled to be drawn out on and can end on any day of the month. When a hold period is ended, the monthly auto payments will resume on the return date.

INITIAL 10-DAY CANCELLATION POLICY You, the buyer, may cancel this agreement at any time prior to midnight of the tenth (10th) calendar day after you have signed this agreement. To cancel this agreement written notice must be received by FIT4MOM Montgomery County within the initial ten days. You are responsible for paying for classes already attended.

AGREEMENT By purchasing this contract, you are agreeing to the terms of this contract. Terms of this agreement may change with proper advance written notice.

Notice of Consumer Rights

1. Our business registration number with the State’s Consumer Protection Division is E5017.

2. We are not required to carry a performance bond under the Maryland Health Club Services law because we do not accept more than three months of payment in advance or charge initiation fees over $200.

3. If FIT4MOM Montgomery County is closed for a month or more, you are entitled to your choice of either an extension of your class plan or a prorated refund. If the closing is not the fault of the business, we are entitled to choose either the extension or refund.

4. You have the right to cancel this agreement within three business days after receipt of a copy of this agreement. Cancellation must be in writing, and delivered in person or by certified or registered mail. If you cancel, you are entitled to a full refund of all monies paid.

5. If you become disabled for at least 3 months during the membership term and if the disability is confirmed in writing by a physician, you are entitled to an extension of your class plan. Since we are exempt from the bonding requirement, we cannot collect payments during a member’s disability extension so that we are not holding more than three months of payment in advance.

This notice is an integral part of the application and contract for membership.
